2. The petitioner is in custody in connection with Agiaon Bazar P.S. Case No. 41 of 2025 for the offence punishable under sections 75, 81, 84, 126(2) and 3(5) of the B.N.S., lodged on 03.04.2025 by the informant, Pushpa Devi.
3. As per the prosecution story, the informant alleged that this petitioner had evil eye on her married daughter and twice he took her away. This led to the F.I.R.
4. Learned counsel for the petitioner straight away has taken this Court to the statement made by the victim (Annexure2, page 17) according to which the lady made a statement that she is twenty years old, had relationship with this petitioner, got married to another person but was always tortured as such, on her own she moved with this petitioner and is now staying as a

5. Learned APP opposes the prayer for bail submitting that the petitioner has taken away the married lady.
6. Allegation is there, victim has come forward and has narrated the situation under which she has moved alongwith this petitioner, F.I.R. has been filed and it will take its own course, is in custody since 03.05.2025 having no criminal antecedent, in that background, this Court is inclined to extend him the privilege of bail.
7. Let the petitioner be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of like amount each to the satisfaction of learned Judicial Magistrate, Bhojpur at Ara, in connection with Agiaon Bazar P.S. Case No. 41 of 2025 subject to the following conditions: (i) one of the bailor should be the family member/relative of the petitioner who shall provide official document to show his/her bona fide;
(ii) the petitioner shall appear on each and every date before the Trial Court and failure to do so for two consecutive dates without plausible reason will entail cancellation of his bail bond by the Trial Court itself;
(iii) the petitioner shall in no way try to induce or
Patna High Court CR. MISC. No.55517 of 2025(2) dt.12-08-2025 3/3 promise or threat the witnesses or tamper with the evidences, failing which the State shall be at liberty to take steps for cancellation of the bail bonds;
(iv) the petitioner shall desist from committing any criminal offence again, failing which the State shall be at liberty to take steps for cancellation of his bail bonds. (Rajiv Roy, J) vinayak/- U T
