JUSTICE SUDHIR SINGH ORAL ORDER 13-09-2018 Heard learned counsel for the petitioner and learned A.P.P. for the State.

The petitioner is languishing in custody since 26.01.2018 in a case for the offence registered under Sections 343 and 365/34 of the IPC.

The prosecution story, in brief, is that on 26.03.2015, four accused persons including this petitioner who are residents of neighbouring village had gone to Sabour Market together and they took the father of the informant, namely, Arun Mandal some where else. His father's Mobile was switched-off. It is alleged that all four accused persons have concealed his father and in search, 2-3 days elapsed which has been stated as the reason for delayed F.I.R.

Patna High Court Cr.Misc. No.46061 of 2018 (3) dt.13-09-2018 2/2 It has been submitted by learned counsel for the petitioner that the petitioner has got no criminal antecedent. Charge sheet has been submitted in the present case. There is no allegation of tampering with the witnesses alleged against the petitioner. There is no allegation of abduction or kidnapping alleged against the petitioner nor there is allegation of illegal confinement of the victim made by the petitioner. There is no eye witness to the alleged occurrence. Except for suspicion, there is no other material to suggest the implication of the petitioner in the present case.

On behalf of the learned counsel for the State, it has been submitted that the petitioner is named in the F.I.R. Considering the aforesaid facts and circumstances, let the petitioner above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned J.M. Ist Class, Bhagalpur, in connection with Sabour P.S. Case No. 51 of 2015. U.K./- (Sudhir Singh, J) U T
