JUSTICE DINESH KUMAR SINGH ORAL ORDER 03-05-2016 Heard learned counsels for the petitioner and the State. The petitioner is languishing in custody since 11.10.2015 in a case registered for the offences punishable under sections 399, 402, 120B of the IPC, under Sections 25(1-B)A, 26, 35 of the Arms Act and under Sections 18, 22, 24 and 25 of N.D.P.S. Act.

On information that miscreants are preparing to commit dacoity, raid was laid. From the vegetable shop of the petitioner 30 sachets of Ganja, few sound speakers and other articles were recovered.

It is submitted by learned counsel for the petitioner that weight of seized contraband has not been mentioned by the

Patna High Court Cr.Misc. No.19779 of 2016 (2) dt.03-05-2016 2/2 informant.

Considering the fact that weight of contraband has not been mentioned by the informant and investigation against the petitioner has already been concluded, let the above named petitioner be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge-II, Patna in connection with Special case No. 34/ 2015 arising out of Chowk P.S. Case No. 234 of 2015.

The learned court below shall be at liberty to cancel the bail bonds of the petitioner in case the petitioner gets involved in similar offence or defaults without any reasonable cause on three consecutive occasions.
