Petitioner, already in custody, seeks bail in connection with Sono (Charkapathar) P.S. Case No.115 of 2017, registered under Sections 147, 148, 149, 120(B) and 121 of the Indian Penal Code, under Sections 3/4 of the Explosive Substance Act as well as under Sections 16, 17, 18, 19, 20, 21 and 22 of the U.A.P. Act.

Allegation in the FIR is that getting secret information, police reached in the forest area and apprehended some suspected members of the extremist group including the petitioner and at their instance, eight pipe bombs each of 5 Kgs. and one cane bomb of 10 Kgs. were recovered.

Learned counsel for the petitioner seeks bail of the

Patna High Court Cr.Misc. No.25963 of 2018(6) dt.27-07-2018 2/2 petitioner on the ground of parity as one of the co-accused Ramdeo Kora, also apprehended along with the petitioner, was enlarged on bail by a co-ordinate Bench of this Court vide order dated 28.06.2018, passed in Cr. Misc. No.31933 of 2018 and in addition to that it is submitted that the petitioner has no antecedent and has been in custody for last one year as well as the recovery is not made from his possession. Having considered the aforesaid facts and circumstances, petitioner Jhari Murmu @ Jhari Murmur is directed to be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M., 1st, Jamui in connection with Sono (Charkapathar) P.S.
