JUSTICE VINOD KUMAR SINHA ORAL ORDER 09-02-2017 Heard the learned counsel for the petitioners. The petitioner is apprehending his arrest in connection with Sasaram (M) P.S. Case No. 573/ 2016, registered for the offence under Section 366(A)/34 of the Indian Penal Code. It has been submitted on behalf of the petitioner that though there is allegation of kidnapping of the victim girl- Arti Kumari, but the statement of the victim girl recorded under section 164 of the Cr. P.C., which is Annexure-2, clearly shows that she had gone to her 'Nani' village on her own sweet will and there is no allegation against the petitioner.

Heard learned A.P.P. also.

Having heard both sides and in view of the statement of the victim girl under Section 164 Cr. P.C., let the petitioner, named above, in the event of their arrest or surrender in the court below within a period of four weeks from the date of receipt/ production of a copy of this order, be released on bail on furnishing bail bonds of Rs. 15,000/- with two sureties of the like
