Mr. Dr. Ajeet Kumar ====================================================== CORAM: HONOURABLE MR. JUSTICE ARUN KUMAR ORAL ORDER 27-07-2018 Heard learned counsel for the petitioner, the learned APP for the State as well as the learned counsel appearing on behalf of the informant.

Petitioner, already in custody, seeks bail in connection with Begusarai Muffasil P.S. Case No.434 of 2014, registered under Sections 302/34 and 120(B) of the Indian Penal Code as well as under Section 27 of the Arms Act.

Allegation in brief is that the petitioner hatched conspiracy in killing the informant's son and three persons Rahul Kumar, Bhushan Singh and Vishal Kumar shot at the son of the informant causing his death.

Learned counsel for the petitioner submits that there is specific accusation of killing against three persons, Rahul

Patna High Court Cr.Misc. No.28773 of 2018(5) dt.27-07-2018 2/2 Kumar, Bhushan Singh and Vishal Kumar and according to the FIR, even the petitioner was not present at the place of occurrence. The only allegation against the petitioner is of hatching conspiracy but there is no such evidence against the petitioner. The only material against the petitioner is that he has number of criminal antecedents and many cases have been lodged earlier by the informant side due to land dispute; whereas the learned counsel appearing on behalf of the informant opposes the prayer of bail of the petitioner and submits that the petitioner has a large number of criminal antecedents.

Having considered the aforesaid facts and circumstances and nature of evidence available in this case against the petitioner, petitioner Niranjan Singh @ Niranjan Prasad Singh is directed to be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned CJM, Begusarai in connection with Begusarai Muffasil P.S. Case No.434 of 2014. (Arun Kumar, J) S.KUMAR/- U T
