JUSTICE VINOD KUMAR SINHA ORAL ORDER 03-05-2017 The petitioner is apprehending his arrest in connection with Baunsi P.S. Case No. 193 of 2016, registered for offences punishable under Sections 406 and 409 Indian Penal Code. Allegation against the petitioner is of defalcation of Government money.

It has been submitted on behalf of the petitioner that it is alleged that petitioner being the Panchyat Secretary was allotted the work for construction of pakka nala for which an amount of Rs. 1,19,050/- was sanctioned out of which Rs. 1,17,714/- has been spent on construction work and misappropriate remaining amount did not complete the work. However, the work has duly been completed, which has also been verified by the Engineer and recommended by Block Development Officer, Banka. In support

Patna High Court Cr.Misc. No.18351 of 2017 (2) dt.03-05-2017 2/2 of his contention he has filed the letter of Block Development Officer, showing the status of work allotted to the petitioner, which is annexed as Annexure -2 to this petition. Heard learned A.P.P. also.

Having heard both sides, in view of the facts and circumstances of the case, nature of allegation and also in view of Annexure -2 series, let the petitioner above named, in the event of his arrest or surrender before the court below within a period of six weeks from the date of receipt/production of a copy of this order, be enlarged on bail on furnishing bond of Rs. 25,000 (Rs. Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned CJM, Banka in connection with Baunsi P.S. Case No. 193 of 2016, subject to the conditions as laid down under Section 438(2) of the Cr.P.C. (Vinod Kumar Sinha, J) sunil/- U
