2. The petitioner seeks regular bail in connection with Itarhi P.S. Case No. 103 of 2025 for the offences registered under Section 30(a) of the Bihar Prohibition & Excise Act.
3. There is recovery of 276.480 litre illicit liquor from a tractor which was driven by the petitioner.
4. Learned counsel for the petitioner submits that petitioner is innocent and has falsely been implicated in this case. Petitioner is not the owner of the said tractor. He had no knowledge about the said liquor kept in the trolley of the tractor. Petitioner has no concern with the seized liquor. Nothing has been recovered from the conscious possession of the petitioner. Chargesheet has already been submitted after conclusion of the
Patna High Court CR. MISC. No.57892 of 2025(2) dt.10-09-2025 2/2 investigation. Petitioner has no criminal antecedent. He is in custody since 10.06.2025.
5. Learned counsel appearing on behalf of the State opposes the prayer for grant of bail to the petitioner.
6. Considering the submissions made on behalf of the parties, facts and circumstances of the case and period of custody, let the petitioner, named above, be enlarged on bail upon furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Exclusive Special Judge, Excise Court No.-1, Buxar in connection with Itarhi P.S. Case No. 103 of 2025.
