The petitioner apprehends his arrest in Mahila (Begusarai) P.S. case No. 27 of 2016 under Section 498A, 323 of the Indian Penal Code and under Section 3⁄4 of Dowry Prohibition Act.

The learned counsel for the petitioner submits that petitioner is husband of the informant but he is ready to keep his wife on any undertaking but from perusal of the FIR it appears that informant earlier also filed a complaint case No. 29C of 2015 against the petitioner and others. Thereafter, the petitioner persuaded the informant to accompany him to his house but the petitioner again assaulted the informant and he solemnized second

Patna High Court Cr.Misc. No.10453 of 2017 (2) dt.15-03-2017 2/2 marriage with Shabnam Pravin and he brutally assaulted the informant on 15.07.2016.

Considering the nature of allegation made against the petitioner, I am not inclined to enlarge the petitioner on anticipatory bail. Accordingly, the same is rejected. (Prabhat Kumar Jha, J) BKS/- U T
