The petitioner seeks regular bail in connection with Motipur P.S. Case No. 97 of 2019 for the offences punishable under Section 392 of the Indian Penal Code .

The allegation is regarding unknown accused persons having intercepted the informant, whereafter they are said to have snatched the pick up van and fled away.

The learned counsel for the petitioner submits that the petitioner is not named in the FIR and has not been put on test identification parade so as to connect him with the alleged crime, hence the petitioner cannot be said to be having any complicity in the alleged crime. The petitioner is stated to be an accused in one case, but he is on bail in the said case. It is

Lastly, it is submitted that similarly situated co-accused person has already been granted bail by a coordinate Bench of this Court vide order dated 12.09.2019 passed in Cr. Misc. No. 57196 of 2019.

Having regard to the facts and circumstances of the case, the petitioner, above named, is directed to be enlarged on regular bail on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of learned S.D.J.M. (West), Muzaffarpur in connection with Motipur P.S. Case No. 97 of 2019.
