JUSTICE DINESH KUMAR SINGH ORAL ORDER 27-04-2016 Petitioners being parents of the husband of the informant are apprehending their arrest in a case registered for the offences punishable under Sections 498A, 494, 34 of the Indian Penal Code and Section 3/4 of the Dowry Prohibition Act.

The basic accusation is of torture and performing second marriage.

It is submitted by learned counsel for the petitioners that initially the F.I.R was lodged against the family members of the husband of the informant but now chargesheet has only been submitted under Section 498A I.P.C against the husband of the informant. It is further submitted that husband of the informant has filed Matrimonial Suit No. 184 of 2015 for the restitution of conjugal life.

No.18459 of 2016 (2) dt.27-04-2016 2/2 Considering the fact that thrust of accusation is against the husband of the informant, let the petitioners, above named, in the event of their arrest or surrender before the Court below within a period of 12 weeks from today, be released on anticipatory bail on furnishing bail bond of Rs. 10,000/-(ten thousand) each with two sureties of the like amount each to the satisfaction of learned Sub-Divisional Judicial Magistrate, Bhagalpur in connection with Bhagalpur Mahila P.S. Case No. 60 of 2015, subject to the conditions as laid down under Section 438(2) of the Cr.P.C. (Dinesh Kumar Singh, J) Shageer/- U T
