The petitioner renews his prayer for regular bail in connection with Kursela P.S. Case No. 55 of 2018 registered for the offence under Section 304(B) of the Indian Penal Code pursuant to the order dated 30.10.2018 passed in Cr. Misc. No. 59606 of 2018.

A report from the court of learned Additional District & Sessions Judge VIth Incharge, Katihar has been received and from perusal of the same it appears that the case is fixed for the evidence of the prosecution.

Taking into consideration the nature of the allegation

Patna High Court CR. MISC. No.53401 of 2019(5) dt.26-11-2019 2/2 against the petitioner, I am not inclined to grant the privilege of regular bail to the petitioner.

However, if the trial is not concluded within a further period of one year, the petitioner may renew his prayer for bail. The application is rejected.
