The petitioner is apprehending his arrest in connection with Belsand P.S.Case No.71 of 2016 registered for offences punishable under Sections302/34 of the Indian Penal Code. It is submitted on behalf of the petitioner that the he has been falsely implicated in this case only on the basis of suspicion as he had illicit relation with the deceased but there is no recovery from the possession of the petitioner and he is no way connected with the case.

Heard learned A.P.P. also.

Having heard both sides and from perusal of the impugned order, it appears that in Para 30 of the Case diary son of the informant has supported the version of the F.I.R. in his statement

Patna High Court Cr.Misc. No.16641 of 2017 (2) dt.10-04-2017 2/2 made under Section 164 Cr.P.C., in which he has also named the petitioner as assailant. There are also other materials available in the case diary against the petitioner. As such, I am not inclined to grant anticipatory bail to the petitioner.

Considering all aspects of matter, as aforesaid, the prayer for bail of the petitioner is rejected.
