The petitioner seeks bail in Sasaram (Model) P.S. Case No. 352 of 2017 registered for the offence punishable under Section 379 of the Indian Penal Code.

Allegation against the petitioner is of committing theft.

It has been submitted on behalf of the petitioner that he is innocent and has been falsely implicated in this case on mere suspicion as FIR is against unknown. It has been further submitted that nothing has been recovered from the possession of the petitioner and neither the petitioner has been put on TIP. Similarly, situated co-accused person has been granted bail by a co-ordinate bench of this Court vide order dated 10.04.2018

Patna High Court Cr.Misc. No.33569 of 2018(4) dt.14-08-2018 2/2 passed in Criminal Miscellaneous No. 19536 of 2018. Petitioner is in custody since 24.02.2018.

Considering the aforesaid facts and circumstances of the case, let the petitioner named above be released on bail upon furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Rohtas at Sasaram, in connection with Sasaram (Model) P.S. Case No. 352 of 2017. (S. Kumar, J) ranjan/- U
