JUSTICE VINOD KUMAR SINHA ORAL ORDER 26-08-2019 This is an application for grant of anticipatory bail in connection with Biraul P.S. Case No. 284 of 2016, disclosing offences under Sections 409 and 420 of IPC.

Prosecution case is of defalcation of Rs.3,20,686/- against the petitioner who is working as Postal Assistant in Sub Post Office, Biraul, Darbhanga.

Submission of the learned counsel for the petitioner is that due to mistake he has not entered in the ledger book and as soon as he came to know he has deposited the same and the aforesaid fact was entered in the ledger book which will appear from the letter of Superintendent of Postal Services, series Annexure-2.

Having heard both sides, considering the above

Patna High Court CR. MISC. No.53255 of 2019(2) dt.26-08-2019 2/2 submission, this application is allowed. Let the petitioner, above named, in the event of his arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount to the satisfaction of learned C.J.M., Darbhanga, in connection with Biraul P.S. Case No. 284 of 2016, subject to the condition laid down under Section 438(2) of the Code of Criminal Procedure.
