====================================================== CORAM: HONOURABLE MR. JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 21-09-2024 Heard learned counsel for the petitioners and the State.
2. Petitioners apprehend arrest in a case registered for the offence punishable under sections 341, 323, 354B,504, 506/149 of the Indian Penal Code.
3. As per the prosecution case, all the FIR named accused persons including these petitioners abused and assaulted the informant and tore her clothes and took away gold chain and Jiutiya.
4. It is submitted on behalf of the petitioners that parties are agnate and have land dispute and on the date of occurrence, informant was constructing house over the common path way without consent of the accused side and when the
Patna High Court CR. MISC. No.62568 of 2024(2) dt.21-09-2024 2/2 same was protested, they lodged this case with false allegation. Doctor has found simple injury. Rest of the allegations are ornamental to make the case grave. Petitioners claim clean antecedent.
5. Considering the aforesaid facts of the case, prayer for bail of all the petitioners is allowed. In the event of arrest/surrender within eight weeks from today, let these petitioners, mentioned above, be enlarged on bail on furnishing bail bond of Rs.10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate VI, Vaishali at Hajipur in Bhagwanpur Police Station Case No. 66 of 2024, subject to the conditions laid down under section 438(2) of the Code of Criminal Procedure.
