The petitioner is languishing in custody since 10.12.2014 in a case registered for the offences punishable under Sections 147, 149, 323, 337, 338, 307, 504 of the Indian Penal Code and 3/4 of the Prevention of Witch Practices Act. Subsequently, section 302 of the IPC was added. It is alleged that nine FIR accused persons including the petitioner assaulted the father of the informant with lathi, danda, stones and bricks as a result he got unconscious and subsequently succumbed to the injuries. Co-accused Dayanand Prasad, Rakesh Kumar and Ram Pravesh Prasad assaulted the family members of the informant who came to rescue the victim.

No.13111 of 2015 (03) dt.01-05-2015 2/2 It is submitted by learned counsel for the petitioner that the injury report of the father of informant suggests only one injury on the scalp and accusation is omnibus and general against nine persons. A statement has been made in para 3 of the petition that the petitioner has no criminal antecedent and investigation has already concluded.
Considering the aforesaid facts, let the above named petitioner, be released on bail on furnishing bail bonds of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Gaya in connection with Belaganj P.S.
