This is the third attempt of the petitioner to seek bail as earlier by order dated 17.03.2020 passed in Cr. Misc. No. 74077 of 2019 and thereafter by order dated 17.02.2021 passed in Cr. Misc. No. 6733 of 2021, the prayer for bail of the petitioner was rejected.
Learned counsel for the petitioner submits that the petitioner has remained in custody since 28.03.2019 and till date charges have not been framed, thus it is submitted that the present bail application has been filed solely on the ground of custody of the petitioner. It is further submitted by the learned counsel for the petitioner that in the event of acquittal of the petitioner in the trial, how his period of incarceration would be
Patna High Court CR. MISC. No.66846 of 2021(3) dt.27-04-2022 2/2 compensated and in the event if the petitioner is convicted, then he will serve the sentence.
Learned A.P.P. for the State opposes the prayer for bail of the petitioner.
Considering the period of custody of the petitioner and the fact that till date, the charges have not been framed, the petitioner above named is directed to be released on bail on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned court below where the case is pending/successor court in connection with Maigra P.S.
