2. The present petition has been filed for modify the order dated 03.02.2023 passed in Cr. Misc. No. 57885 of 2022.

3. Earlier from the order passed in Cr. Misc. No. 57885 of 2022 (disposed of on 03.02.2023), it is clear that this Court had taken note of the fact that the present petitioner, Akhilesh Kumar @ Akhilesh Sah was an order giver and subsequently, there was also an allegation of firing against him, as such his prayer for anticipatory bail was rejected.

4. However, erroneously and due to fault on behalf of the Stenographer which was also overlooked by this Court, while granting relief to the other accuseds, the name of the

Patna High Court CR. MISC. No.78873 of 2023(2) dt.01-12-2023 2/2 present petitioner Akhilesh Kumar @ Akhilesh Sah was also incorporated.

5. The Trial Court was fully justified in not entertaining the bail bond of this petitioner, Akhilesh Kumar @ Akhilesh Sah and this Court has lots of word of appreciation for the Trial Court for stalling the same.

6. Having gone through the order sheet, it is clear that no relief was extended to the petitioner, Akhilesh Kumar @ Akhilesh Sah.

7. The Cr. Misc. No. 78773 of 2023 stands rejected. (Rajiv Roy, J) Neha/- U T
