This is a second attempt made by the petitioner for grant of anticipatory bail in connection with Patliputra Police Station Case No 276 of 2015 registered for the offence under Sections 406, 420 of the Indian Penal Code.
It has been submitted by the petitioner that earlier the petitioner moved for anticipatory bail and this Court, vide order dated 11.01.2017 passed in Cr Misc No 52948 of 2016, has rejected the anticipatory bail application of the petitioner, but now he is ready to pay the amount, subject to objection. Heard also the learned APP.
In view of above submission, let petitioner surrender
Patna High Court Cr.Misc. No.9883 of 2017 (2) dt.22-03-2017 2/2 before the Court below within a period of one month from today and pray for bail and if petitioner deposits a bank draft of Rs 24 lacs, the Court below, after hearing Opposite Party No 2, will pass an appropriate order with regard to the release of the aforesaid sum and that release would be subject to the final outcome of the case and also pass an appropriate order on his bail application on the above background.
This application is, accordingly, disposed of. Till the surrender of the petitioner in the Court below, no coercive step will be taken against him.
