2. Petitioner seeks regular bail in connection with Muffasil P.S. Case No. 153/ 2024 dated 28.04.2024 registered for the offence(s) punishable under Sections 147, 148, 149, 341, 323, 326, 307, 504 and 387 of the IPC and section 27 of the Arms Act.

As per the prosecution's story, on 25.04.2024, while the informant's nephew was going to school this petitioner along with other accused persons stopped him, abused him and demanded extortion of Rs. 50,000/-. It is further alleged that when the extortion demand was not fulfilled then on 27.04.2024, the accused persons, including the petitioner,
Patna High Court CR. MISC. No.56349 of 2025(2) dt.12-08-2025 2/3 assaulted two nephews and cousin of the informant and firing was also made in the occurrence in which three persons sustained firearm injuries.

The main submissions advanced by the petitioner's counsel are that three similarly situated accused persons, namely, Robin Rai, Pintu Rai and Sunil Rai have been granted bail by co-ordinate benches of this court vide orders dated 23.09.2024 and 09.07.2025 passed in Cr. Misc. Nos. 65753 of 2024 and 41223 of 2025, respectively. In fact, the prosecution party injured one of the persons belonging to the petitioner's side and there is case and counter case in between the parties.
5. The learned APP appearing for the State has opposed the bail prayer of the petitioner.
6. Heard both the sides, perused the FIR and trial court's order. As per the allegation, this petitioner and other accused persons first made extortion demand of Rs. 50,000/- from the informant's nephew and when the said extortion demand was not fulfilled on 27.04.2024, the informant's nephews, Nitish Kumar and Raja Kumar, and his cousin brother, Awadhesh Rai, were abused by the accused persons, including the petitioner, and thereafter fired upon them resulting in firearm injuries to three persons. As per the allegation, the petitioner

No.56349 of 2025(2) dt.12-08-2025 3/3 was one of the assailants and against him there are criminal antecedents of six cases and as per the trial court's order, three persons sustained injuries in the alleged occurrence. Considering the seriousness of the allegations and also the long criminal history of the petitioner, this court is not inclined to release the petitioner on bail. Accordingly, the same stands rejected.
