The petitioner, Niro Sahni @ Niraj Sahni, seeks regular bail in Kasim Bazar P.S. Case No.24 of 2013, registered under Sections 392 and 411 of the Indian Penal Code. The informant lodged the case against unknown for committing robbery.
Learned counsel for the petitioner submits that the petitioner is not named in the first information report. His name figured in the case in the confessional statement of co-accused Birju Sahni and nothing has been recovered from the possession of the petitioner. Petitioner was not put to T.I. parade. Perused the record.
Having considered the facts that the petitioner is not named in the first information report and his name figured in the
Patna High Court Cr.Misc. No.51887 of 2014 (2) dt.05-01-2015 2/2 confessional statement of the co-accused, but thereafter the petitioner was not put to T.I. parade even though he is in jail since 02.06.2014, his prayer for bail is allowed. The petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate 1st Class, Munger in connection with Kasim Bazar P.S.
