This is a petition for grant of anticipatory bail for offence under Sections 419, 409 and 420 of the Indian Penal Code.
The petitioner was headmaster of the school and allegation is of defalcation of rupees three lakhs out of the total money allocated for construction of the school building. The petitioner has annexed statement of expenditure, at Annexure 4, and submits that the authorities without proper verification of the matter has lodged the case. The petitioner has already spent Rs.8,32,626/- out of total allocated money of Rs.8.11/- lakh and odd.
Considering the aforesaid fact, the petitioner,
Patna High Court Cr.Misc. No.13762 of 2017 (3) dt.10-05-2017 2/2 above named, in the event of his arrest or surrender, within four weeks from the date of receipt of this order, be released on furnishing bail bond of Rs.10,000/- (rupees ten thousand) with two sureties of the like amount each in connection with Mahishi P.S. Case No. 128 of 2016 to the satisfaction of the Subdivisional Judicial Magistrate, Saharsa, or successor Court, subject to the condition laid down under Section 438(2) of the Criminal Procedure Code with the condition that the petitioner shall get the account settled by filing representation to the competent authorities along with the relevant papers.
