Petitioner seeks regular bail in connection with Nowkothi PS Case No. 06 of 2021 instituted for the offence under section 25 (1-B)a / 26 / 35 of the Arms Act. As per the first information report, it is alleged that one loaded country made pistol and two live cartridges have been recovered from the petitioner.

Learned counsel for the petitioner submits that petitioner has not committed any offence in the manner alleged and he has falsely been implicated in this case by the police with oblique motive. Learned counsel submits that no arms and ammunitions have been recovered from the conscious possession of the petitioner rather the alleged recovery has been

Regard being had to the submissions made by the parties, taking into consideration the material on record, the fact that petitioner has got no criminal antecedent, he is in custody since 10/01/2021 and charge sheet has already been submitted, as such, I am inclined to grant regular bail to the petitioner. Let the petitioner, above named, be released on regular bail on furnishing bail bond of Rs. 20000/- (twenty thousand ) with two sureties of the like amount each to the satisfaction of Mr. Rajeev Ranjan, learned Judicial Magistrate 1st Class, Begusarai in connection with Nowkothi PS Case No. 06 of 2021.
