2. As per the learned counsel for the petitioner, the Encroachment Case No. 8 of 2021-22 has been disposed of by the Circle Officer, Bankatwa, East Champaran, Motihari.

3. On this, learned counsel for the State submits that he will have to seek instruction in this regard.

4. I have heard and considered the submission of the

Patna High Court CWJC No.13359 of 2023(2) dt.08-01-2024 2/2 parties.

5. This application is disposed of with a direction to the Circle Officer, Bankatwa, East Champaran, Motihari that if he has passed any final order and if there is no appeal or writ pending against the same then he may proceed to remove the encroachment. If any appeal or writ is pending against the final order of the circle officer then he will not proceed further in the matter and he will await the order of the appellate Court/this Court.
