This application, for grant of anticipatory bail, arises out of Barouli Police Station Case No. 242 of 2016, disclosing offences under Sections 341, 323, 324, 325, 307, 504 and 34 of the Indian Penal Code.
Learned counsel for the petitioner has submitted that there is land dispute between the parties and for that a case and counter case has been lodged by both the parties, in which, both the parties have sustained injuries. According to annexure- 3 series, the injuries sustained by the informant side are simple in nature caused by the hard and blunt substances. Hence, the petitioner deserves the privilege of anticipatory bail.
Patna High Court Cr.Misc. No.8055 of 2017 (2) dt.23-02-2017 Considering the facts and circumstances of the case, let the petitioner, above named, in the event of his arrest or surrender before the Court below within six weeks, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-XIV, Gopalganj, in connection with Barouli Police Station Case No. 242 of 2016, subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure.
