Learned counsel for the petitioner is permitted to remove defect(s), as pointed out by the office, if any, within a period of four weeks from today.

The petitioner seeks anticipatory bail in connection with complaint case No. 379 of 2018, registered for the offences under Sections 498A, 494, & 34 of the Indian Penal code. The marriage was solemnized in the year 1999. The petitioner has three grown up children.

It has been submitted by the petitioner that opposite party no. 2 had deserted him and thereafter the petitioner had filed matrimonial case, which was decreed exparte and after exparte decree this complaint case was filed in the year 2018.

Let the petitioner, above named, in the event of his arrest/surrender within four weeks from today in the court below, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate 2nd class, Bikramganj, in connection with complaint case no. 379 of 2018, subject to the conditions as laid down under section 438(2) of the Code of Criminal Procedure.

The learned counsel for the petitioner undertakes that the petitioner shall pay the maintenance amount of Rs. 3,000/- per month as decided earlier by the competent court regularly to the opposite party no. 2. The opposite party no. 2 shall provide her bank account details to the petitioner or his Advocate immediately. Any default in payment of maintenance amount of Rs. 3,000/- by the petitioner to the opposite party no. 2 shall result in automatic cancellation of bail bond of the petitioner.
