The petitioners apprehend their arrest in Patahi P. S. Case No. 120 of 2013 registered for the offences under Sections 406, 420 and 34 of the Indian Penal Code.

The informant alleged that the petitioners persuaded him to purchase a tractor and for this the informant deposited margin money, but the petitioners did not provide him the saleletter, on account of which, the vehicle was not registered in the name of the informant.

Leanred counsel for the petitioners submits that all the allegations are false and concocted. The informant filed

Patna High Court Cr.Misc. No.17411 of 2017 (3) dt.19-05-2017 2/2 complaint case on 23.09.2013 on basis of which the present F.I.R. was registered. The informant earlier filed consumer case no. 21 of 2009 before the District Consumer Forum, East Champaran at Motihari and the case was decided on 07.06.2010, thereafter, the informant filed this case.

Considering the facts aforesaid and the nature of allegations made against the petitioners, the above named petitioners, in the event of their arrest or surrender before the learned court below within a period of four weeks from the date of receipt/production of a copy of this order, are directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial MagistrateVIII, Motihari in Patahi P. S. Case No. 120 of 2013, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
