The petitioner seeks bail in connection with G.O. Case No. 156 of 2021 instituted for the offences under Section 30(a) of the Excise Act.

Learned counsel for the petitioner submits that the petitioner is in custody since 13.09.2021, is a person with clean antecedent and prosecution report has been submitted in the case.

Learned counsel for the petitioner submits that allegation is of recovery of 90 litres of liquor from the possession of the petitioner.

No.67029 of 2021(2) dt.18-02-2022 2/2 Learned counsel for the petitioner submits that the petitioner has been falsely implicated in the case, he was a mere passer-by when search was going on and when the accused fled, the S.S.B. personnel roped the petitioner with false allegations. Learned A.P.P. for the State opposes the prayer for bail of the petitioner.

Considering the fact that the petitioner is in custody since 13.09.2021, is a person with clean antecedent and prosecution report has been submitted in the case, let the petitioner above named be released on bail on furnishing bail bond of Rs. 2,000/- (Rupees Two Thousand) with two sureties of the like amount each to the satisfaction of learned A.D.J.- 2nd, Sitamarhi in connection with G.O. Case No. 156 of 2021. (Satyavrat Verma, J) Rishi/- U T
