While this Court would not find the driver's allowance claimed in this writ application by the petitioner to be post retirement benefit, rest of the prayer of the petitioner for a direction for payment of the provident fund amount has to be allowed by directing the Executive Engineer, West Koshi, Canal Division, Benipatti, Madhubani, to immediately comply the requirement as desired by the District Provident Fund Officer, Madhubani in his letter no. 473 dated 10th of

Patna High Court CWJC No.4622 of 2015 (2) dt.06-04-2015 May, 2014 (Annexure-2) so that the payment of the amount of G.P.F. of the petitioner is made as early as possible but in no event beyond the period of one month from the date of receipt of this order.

If the Executive Engineer, West Koshi, Canal Division, Benipatti, Madhubani, has not made compliance of the aforementioned letter of the District Provident Fund Officer dated 10.05.2014, he must do so within a period of 15 days from the date of receipt of this order so that whatever amount of G.P.F. is found payable to the petitioner must be paid in next 15 days. With the aforementioned observation and direction, this application is disposed of.
