2. The petitioner seeks bail in a case registered for the offence punishable under Sections 302 and 34 of the Indian Penal Code.
3. The prosecution story, in brief, is that on 11.06.2024 at about 5:00 P.M., when the informant along with his father, namely Bahadur Rai, were going to the house of Mahesh Yadav to demand their money, in the meantime, all the F.I.R. named accused persons, including the petitioner, armed with lathi and iron rod, brutally assaulted both of them, due to
Patna High Court CR. MISC. No.55999 of 2025(3) dt.03-11-2025 2/3 which, the informant's father succumbed to his injuries.
4. It is submitted by learned counsel for the petitioner that petitioner is quite innocent and has committed no offence. As a matter of fact, there is series of cases between the parties and only with a view to harass and humiliate the petitioner, this false and concocted case has been lodged after the death of father of the informant. Allegation of assault is general and omnibus and no specific accusation of overt act has been alleged against this petitioner. Moreover, charge-sheet has already been submitted and petitioner is in custody since 06.03.2025.

On the other hand, learned A.P.P. for the State and learned counsel for the informant have vehemently opposed the prayer for grant of bail to the petitioner and submitted that petitioner is named in the F.I.R. with specific accusation that he, along with other accused persons, assaulted informant and his father due to which, father of informant died. The post mortem report also corroborates the allegations. Petitioner has got six criminal antecedents.
6. Considering the facts and circumstances of the case, specific and direct nature of accusation and criminal antecedent of the petitioner, the prayer for grant bail of to the
