Petitioner seeks bail in a case registered for the offences punishable under Sections 302, 201, 376/34 of the Indian Penal Code and Section 4/6 of the Protection of Children from Sexual Offenses Act, 2012.

According to FIR, the daughter of the informant who was playing out side the house, was found traceless. Subsequently, her dead body was recovered. Suspicion is there against the petitioner and others of commission of rape and murder. Submission is that the petitioner is in custody since 25.05.2016. Co-accused Anil Prasad @ Gorakh Sao, having similar allegation, has already been allowed bail by a Coordinate

Patna High Court Cr.Misc. No.36835 of 2018 (6) dt.27-08-2018 2/2 Bench of this Court vide order dated 10.11.2015 passed in Cr. Misc. No. 43315 of 2015 (Annexure-2) after going through the material in the case diary.

Considering the aforesaid facts, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court below where the case is pending in connection with POCSO Case No. 23 of 2015 arising out of Nasriganj P.S. Case No. 72 of 2015, subject to the condition that the petitioner shall fully cooperate with the investigation/trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner as well as condition that both the bailors shall be resident of the territorial jurisdiction of the learned court below.
