The petitioner has prayed for regular bail in a case registered for the offence punishable under sections 147, 148, 149, 341, 323, 325, 380, 307 of the Indian Penal Code. Allegation against the petitioner is of assaulting to the informant and his family members by means of iron rod due to which the informant sustained injuries.

Learned counsel for the petitioner submits that the petitioner is innocent and has committed no offence. A land dispute regarding partition, is going on between the parties due to which the petitioner has falsely been implicated in this case. There is case and counter case between the parties and the FIR lodged after laps of 7 days of the alleged occurrence. The

No.56933 of 2022(2) dt.19-01-2023 2/2 allegation of assaulting against the petitioner to injured namely, Rajdev Mahot who sustained all injuries as simple except one injury which is grievous in nature. It is further submitted that the petitioner is languishing in judicial custody since 4.8.2022. Learned APP appearing for the state has opposed the prayer of regular bail.

Having heard learned counsel for the parties and considering the facts and circumstances of the case, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be released on bail in connection with Babubarhi P.S. Case No. 183 of 2016 on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned J.M. 1st Class, Madhubani.
