2. The petitioner nos. 2 and 3 have already been granted bail by a co-ordinate Bench of this Court vide order dated 12.09.2023. Now, this bail application is only confined to petitioner no. 1, namely, Anil Kewat.

3. The petitioner no. 1 seeks bail in connection with Kadawa P.S. Case No. 97 of 2023 registered for the offence punishable under Sections 341, 342, 323, 498A and 305(B)/34 of the Indian Penal Code.

4. As per the prosecution case, the petitioners and

5. During investigation it has come that the deceased was working in Himachal Pradesh and on the date of occurrence, he was not present in his house. It has further come that the deceased has consumed poison and she was taken to hospital for treatment. The petitioner is in jail since 31.05.2023.

6. Learned APP appearing for the State opposes the prayer for regular bail of the petitioner.

7. Considering the aforesaid facts and circumstances of the case and submissions of learned counsel for the parties, let the petitioner no. 1, namely, Anil Kewat be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Katihar in connection with Kadwa P.S. Case No.97 of 2023.
