The Petitioners apprehend their arrest in Sessions Trial No.509 of 2016 arising out of Bochahan P.S. Case No.77 of 2006 instituted for the offence under Section(s) 302, 307, 341, 323/34 Indian Penal Code pending in the Court of the Sessions Judge, Muzaffarpur.

The learned Sessions Judge has mentioned in the impugned order that earlier prayer of the petitioners for grant of anticipatory bail was rejected in the year 2010 and thereafter these petitioners remained absconder and again filed application for anticipatory bail in the year 2017, which was rejected. Case dairy was called for.

In para 42 of the case diary, it is mentioned that

Patna High Court Cr.Misc. No.13081 of 2017 (3) dt.20-04-2017 2/2 charge-sheet was submitted against these petitioners on 31.03.2009 showing them absconder.

In view of such, this Court does not find it a fit case for grant of anticipatory bail.

Prayer is rejected.

The petitioners may surrender before the Court below and seek regular bail, which shall be considered and disposed off, in accordance with law, preferably on the same day without being prejudiced by this order.
