The petitioner has preferred this application for grant of regular bail in a case registered under sections 354, 341, 323, 504 and 506 of the Indian Penal Code.

As per the prosecution case, it is sated by the informant that when she went to use the toilet in the train, she forgot to lock the door from inside. The petitioner who was travelling in the same train, pushed the door of the toilet, entered, misbehaved and assaulted the informant. It is submitted by learned counsel for the petitioner that the petitioner has been falsely implicated in the case. No such occurrence as alleged in the FIR has taken place. The dispute between the parties was for other reasons. The petitioner is in custody since 16.8.2021 and has no criminal antecedent.

Having heard learned counsel for the parties and taking into consideration the nature of allegations in the FIR, the petitioner having remained in custody for 8 months and not having any criminal antecedent, the petitioner is directed to be enlarged on bail in connection with Chapra Rail P.S. Case no. 100 of 2021 on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional District Judge 1st , Saran at Chapra.
