1. Heard learned counsel for the petitioner, learned A.P.P. for the State and learned counsel appearing on behalf of the informant.

2. The petitioner apprehends his arrest in a case registered for the offences punishable under Sections 127(1), 115(2), 118(1), 76, 109, 303(2), 352, 351(2) and 3(5) of the BNS.

3. Learned counsel for the petitioner submits that petitioner is a person with clean antecedent and the informant alleges that accused persons came and Rajesh Singh assaulted her husband by an iron rod and Anup Singh assaulted by lathi causing injury on head.

4. Learned counsel for the petitioner submits that from perusal of the allegation as alleged in the FIR, it would manifest that no specific allegation of assault is alleged against the petitioner and on account of dispute relating to land an altercation

Patna High Court CR. MISC. No.64163 of 2025(2) dt.23-09-2025 2/2 had taken place in which both sides assaulted each other. It is further submitted that petitioner also suffered injury on which learned counsel appearing on behalf of the informant submits that no doubt the petitioner suffered injury but then the injury has been opined to be simple in nature.

5. Learned A.P.P. for the State and learned counsel appearing on behalf of the informant opposed the prayer for anticipatory bail of the petitioner.

6. Considering the submissions made by the learned counsel for the petitioner, let the petitioner above-named, in the event of his arrest or surrender before the learned trial court within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned trial court where the case is pending/Successor Court in connection with Sinha P.S. Case No. 90 of 2024, subject to the conditions as laid down under Section 482(2) of the BNSS. (Satyavrat Verma, J) Kundan/- U T
