JUSTICE ANIL KUMAR SINHA ORAL ORDER 29-08-2019 The petitioner apprehends his arrest in connection with Hasanganj P. S. Case No. 90 of 2017 registered under Sections 363 and 366A/34 of the Indian Penal Code.

Allegation against the petitioner, as per FIR, is that daughter of the informant was abducted by one Monu Kumar and Rahul Kumar.

Learned counsel appearing on behalf of the petitioner submits that petitioner is innocent and he is not named in the FIR. Learned counsel, relying upon Annexure-2, which is statement of victim girl, submits that the police arrived at the place of captivity of the victim girl, and both persons Monu Kumar and Rahul Kumar were arrested and petitioner was not found at the place of captivity of victim girl. Patna High Court CR. MISC. No.54637 of 2019(2) dt.29-08-2019 2/2 statement has categorically stated that petitioner along with two others had abducted her and forcibly took her to Delhi where she was kept confined in a room with intention to sell her to others and it also appears that she was a minor aged about 16 years, accordingly, I am not inclined to grant anticipatory bail to the petitioner. Accordingly, this anticipatory bail application is dismissed.
