Petitioner, who is in custody, seeks bail in connection with Shambhugan P.S. Case No. 187 of 2017 registered for the offences punishable under Sections 393/34 of the Indian Penal Code and under Section 25(1-b)a, 26/35 of Arms Act. Informant in his written complaint has stated that on 24.11.2017 he was in his house with family at about 11:00 A.M. three accused persons entered his house from behind carrying pistol in their hand, his wife raised alarm but one miscreant pointed his revolver towards her and on his raising alarm people of near vicinity assembled there and all the three miscreants fled away but one of them entered in the house of another villager who was apprehended and two co-accused
Patna High Court Cr.Misc. No.35465 of 2018(5) dt.29-08-2018 2/2 managed to flee away, one pistol and two cartilages has been recovered from the possession of petitioner and he was handed over to the police.
It has been submitted on behalf of the petitioner that he is innocent and has been falsely implicated in the case due to village rivalry. In the supplementary affidavit filed on behalf of the petitioner it has been stated that he is accused in four cases of similar nature. Petitioner is in custody since 24.11.2017. Considering the aforesaid fact and circumstances of the case, let the petitioner named above be released on bail upon furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Banka in connection with Shambhuganj P.S. Case No. 187 of 2017.
