JUSTICE DINESH KUMAR SINGH ORAL ORDER 06-01-2015 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 341,447,323,324,307,379 and 504/34 of the Indian Penal Code. The prosecution case is that when the informant protested for cutting his Semal tree then Munister Sahni started abusing the informant and made assault with Farsa causing injury on the head of the informant. The informant's cousin came to rescue then he was assaulted by Raj Kumar Sahni by lathi on his head, thereafter the informant's nephew Vikas Kumar came to rescue then the petitioner assaulted him.
It is submitted by learned counsel for the petitioner that one lacerated wound of marginal size was found simple in nature while the other injury is bruise of marginal size. There is counter

Statement has been made in paragraph 3 of the petition that the petitioner has no criminal antecedent. Considering the aforesaid facts, let the above named petitioner be released on anticipatory bail in the event of arrest or surrender before the learned Court below within a period of twelve weeks from today on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned CJM, East Champaran at Motihari in connection with Harsidhi P.S. Case No. 127 of 2014 subject to the conditions as laid down under Section 438(2) Cr.P.C.
