JUSTICE VINOD KUMAR SINHA ORAL ORDER 23-03-2017 Heard learned counsel for the petitioner as well as learned Addl. Public Prosecutor.

The petitioner prays for anticipatory bail in connection with complaint case no.915 of 2015 registered for the offence punishable under Sections 323, 379, 504, 506/34 and Section 3/4 of Dowry Prohibition Act.

It is submitted on behalf of petitioner that he is still ready to keep his wife with all dignity and only false and concocted allegations have been levelled against the petitioner. Having heard both sides. Considering the allegations as made in the complaint petition in which there is allegation of assault also and in view of the fact that inspite of compromise between the parties when the complainant went to her

Patna High Court Cr.Misc. No.12135 of 2017 (2) dt.23-03-2017 2/2 matrimonial home, she was again driven out from there, I am not inclined to grant anticipatory bail to the petitioner. As such, his prayer for anticipatory bail is rejected. However, petitioner may surrender before the court below and pray for regular bail and the court below will dispose of the matter on its own merit without being prejudiced by the order of this Court.

With these observations, this bail application is dismissed.
