In the first information report, general allegation of assault has been leveled against the petitioner and other F.I.R named accused persons but in course of investigation, when the statement of witnesses Rita Devi as well as Dharmendar Paswan were recorded, both the aforesaid witnesses claimed to be an eye witnesses and specifically stated that it was co-accused Shankar Paswan, who gave several Farsa blows to the deceased. Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of
