The petitioner, who is in custody, seeks bail in connection with Runisaidpur P.S. Case No. 273 of 2016 registered for the offence punishable under Sections 304B/34 of the Indian Penal Code.

Informant is the father of deceased, who in his written complaint has stated that the marriage of his daughter was solemnized with petitioner on 22.05.2011 and one children was also born from the said wedlock, but after marriage she was being tortured for non-fulfillment of demand of dowry. On 01.07.2016 at about 8.00 AM he received information on mobile from the Pappu Singh that his daughter was burnt. Patna High Court Cr.Misc. No.34372 of 2018(7) dt.06-09-2018 2/2 was being treated and she died during treatment on 02.07.2016.

It has been submitted on behalf of the petitioner that petitioner is innocent and has been falsely implicated in this case. The father of the deceased got information about the occurrence on 01.07.2016 and the FIR has been lodged on 04.07.2016. It has been further submitted that the deceased who was his wife caught fire while she was cooking meal and sustained burn injury, resulting in her death in course of treatment. Petitioner has no criminal antecedent and he is in custody since 05.06.2017.

Considering the aforesaid facts and circumstances of the case, let the petitioner named above be released on bail upon furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Sessions Judge, Sitamarhi, in connection with Runisaidpur P.S. Case No. 273 of 2016.
