1. Heard learned counsel for the petitioners, learned A.P.P. for the State and learned counsel appearing on behalf of the informant.
2. Learned counsel for the petitioners, after arguing for some time realizing his difficulty, seeks permission to withdraw the anticipatory bail application with respect to petitioner no. 1, namely, Rajesh Singh.
3. Permission is accorded.
4. Accordingly, the anticipatory bail application with respect to petitioner no. 1 is dismissed as withdrawn.
5. The petitioner no. 2 apprehends his arrest in a case registered for the offences punishable under Sections 127(1), 115(2), 118(1), 76, 109, 303(2), 352, 351(2) and 3(5) of the
Patna High Court CR. MISC. No.63880 of 2025(2) dt.23-09-2025 2/3 BNS.
6. Learned counsel for the petitioner no. 2 submits that petitioner no. 2 is a person with clean antecedent and the informant alleges that accused persons came and Rajesh Singh assaulted her husband by an iron rod and Anup Singh (petitioner no. 2) assaulted by lathi causing injury on head.

Learned counsel for the petitioner no. 2 submits that no doubt, the order impugned records that parietal bone of the injured was fractured but then the allegation of assault is against Rajesh Singh. It is further submitted that on account of dispute relating to land an altercation had taken place in which both sides assaulted each other and from the side of the petitioner no. 2 Vishal Singh also suffered injury on which learned counsel appearing on behalf of the informant submits that no doubt Vishal Singh suffered injury but then the injury suffered by Vishal Singh has been opined to be simple in nature.
8. Learned A.P.P. for the State and the learned counsel appearing on behalf of the informant opposed the prayer for anticipatory bail of the petitioner no. 2.
9. Considering the submissions made by the learned counsel for the petitioner no. 2 that petitioner no. 2 is alleged to have assaulted by lathi and there is one injury on head leading to
Patna High Court CR. MISC. No.63880 of 2025(2) dt.23-09-2025 3/3 fracture of parietal bone which has been alleged against Rajesh Singh, as such, let the petitioner no. 2 above-named, in the event of his arrest or surrender before the learned trial court within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned trial court where the case is pending/Successor Court in connection with Sinha P.S. Case No. 90 of 2024, subject to the conditions as laid down under Section 482(2) of the BNSS.
