JUSTICE CHAKRADHARI SHARAN SINGH ORAL ORDER 19-05-2015 Heard learned counsel for the petitioner and the learned Additional Public Prosecutor appearing on behalf of the State. This is an application seeking anticipatory bail in a case registered for the offences punishable under Section 406, 409, 419 & 420 of the Indian Penal Code.

The allegation against the petitioner, who was posted as Panchayat Secretary of the concerned Gram Panchayat is regarding irregularities committed in purchase of solar lamp units. Learned counsel for the petitioner has submitted that the petitioner being the Government Servant is not likely to abscond. He also submits that the petitioner will assist/cooperate with the police in the matter of investigation. He has referred to an order of this Court dated 29.01.2015 passed in Cr. Misc. No.

Patna High Court Cr.Misc. No.2852 of 2015 (4) dt.19-05-2015 3804 of 2015 that in similar circumstance arising out of the same Police Station Mukhiya of the Gram Panchayat has been granted privilege of anticipatory bail.

In view of the submissions as above, let petitioner above named in the event of his arrest/surrender within four weeks from today in the Court below be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Buxar in Koransarai P.S. Case No. 73 of 2014, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
