JUSTICE DINESH KUMAR SINGH ORAL ORDER 07-01-2015 Heard learned counsel for the petitioner and the State The petitioner is languishing in custody since 31.08.2014 in case registered for the offences punishable under sections 420,414 and 120B of the Indian Penal Code and section4/5 of the Explosive Substance Act.

The prosecution case is that the police during the course of raid against illegal mining recovered large number of gelatin strips.

It is submitted by the learned counsel for the petitioner that the recovery was not made from the possession of the petitioner rather the explosive materials were recovered form a different place not disclosed by the petitioner and statement to this effect has

Patna High Court Cr.Misc. No.52111 of 2014 (2) dt.07-01-2014 been made in paragraph 6 of the petition.

Considering the place of recovery and the period of custody, let the above named petitioner be released on bail on furnishing bail bond of Rs.10000/- (ten thousand) with two sureties of like amount each to the satisfaction of Chief Judicial Magistrate Rohtas, Sasaram in connection with Sasaram (Mufassil) P.S. Case No.821 of 2014.
