JUSTICE SANJAY PRIYA ORAL ORDER 21-02-2017 Heard learned counsel for the petitioner and the State. The petitioner seeks anticipatory bail in a case instituted for the offence under Sections 285 and 308 of the Indian Penal Code.

It is alleged in the written report that due to negligence of the petitioner who was the Switch Operator of the electric feeder situated at Gaurakshani Feeder, the electricity was not shut down and electric current was passing through the wire, while the deceased Surender Singh was working, on account of which, he was electrocuted.

Learned counsel for the petitioner has submitted that

No.7019 of 2017 (2) dt.21-02-2017 2/2 there is no interpolation in the log book, and in support of which, a copy of the log book is enclosed as Annexure-2 wherein it is mentioned that no fault was found in the log book. In such circumstances, prayer for anticipatory bail of the petitioner is allowed. In the event of surrender/arrest within six weeks from the date of receipt of this order, in connection with Sasaram (Muffasil) P.S. Case No. 810 of 2016, he shall be released on anticipatory bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Sasaram, Rohtas, subject to the conditions as laid down under Section 438 (2) Cr. P.C.
