It is alleged that 10 kgs. ganja as well as 10 plants of ganja were recovered from the joint house of the petitioner. Learned counsel for the petitioner drew my attention towards photostat copy of seizure list and submitted that in seizure list only 8 kgs. Ganja along with plastic bag is said to have been recovered and one Shaildendra Prasad claimed himself to be owner of the aforesaid ganja and, moreover, no seizure was made of so-called ganja plants. It is further contended by him that even if it is assumed that 8 kgs. ganja along with plastic bag was recovered from the joint house of the petitioner, then also, aforesaid ganja comes under the purview of small quantity and for the aforesaid recovery, petitioner is in jail custody since 28.12.2014.

Considering the aforesaid facts and circumstances as well as
