The petitioner is apprehending arrest in a case registered for the offences punishable under Section 307/34 of the Indian Penal Code and 27 of the Arms Act. The accusation is of firing by the petitioner and coaccused Iftekhar @ Pintu causing injury to the informant. It is submitted by learned counsel for the petitioner that the petitioner has not been named in the First Information Report. In the FIR, he was described as brother of co-accused Sabana. The injury report, prima facie, suggests that there are two injuries one is wound of entry and the other one is wound of exit whereas accusation of firing is against two persons. A statement has been made in paragraph 3 of the petition that the petitioner has no criminal antecedent.

Let the learned Court below consider the prayer for regular bail of the petitioner, if the petitioner surrenders within a period of six weeks Manshi (Maheshkhut) Rail P.S. Case No.17 of 2014, pending before the learned Railway Judicial Magistrate, Khagaria.

With the above observation, this application is, accordingly, disposed off.
