The petitioner is accused in connection with Bypass P.S. Case No. 128 of 2015, registered under Section 364/34 of the Indian Penal Code.
The accusation is that on 30.10.2015 in course of quarreling in between Bangali Gope, the husband of the informant and her Jaut, incidentally one fell down. The lady proceeded from there and in the evening, the petitioner came and started abusing saying that why his mother was dashed, then Bangali Gope husband of the informant told that the lady fell down incidentally and there was no intention to dash her. Thereafter, Bangali Gope was accompanied by the petitioner of
Patna High Court Cr.Misc. No.19081 of 2016 (3) dt.29-06-2016 2/2 his home to verify the fact, but he did not return. Learned counsel for the petitioner submits that except the informant none have stated about moving of the husband of the informant with the petitioner. Further submission is that petitioner surrendered before the Court and the Police got recorded the confessional statement remand showing his hand in the murder of the husband of the informant with the help of one Nand Kishore. Except the confessional statement, there is nothing against the petitioner to show his involvement in the present case. The petitioner having no criminal antecedent is in custody since 03.11.2015.
Having regard to the facts and the circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) two sureties of the like amount each to the satisfaction of the Judicial Magistrate, 1st Class, Patna City in connection with Bypass P.S. Case No. 128 of 2015.
